  1. DEFINITIONS

    2. Personal Data – information about an identified or identifiable natural person through one or more specific factors determining physical, physiological, genetic, mental, economic, cultural, or social identity, including device IP, location data, online identifier, and information collected via cookies or other similar technologies.
    3. Policy – this Privacy Policy.
    4. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons regarding the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC.
    5. Service – the website operated by the Administrator at https://baltinvest.pl/la-vie-art/.
    6. User – any natural person visiting the Service or using one or more services or functionalities described in the Policy.
  2. PROCESSING OF DATA IN CONNECTION WITH USING THE SERVICE
    1. When using the Service, the Administrator collects data necessary to provide specific services, as well as information about the User’s activity in the Service. Detailed rules and purposes of processing personal data collected while using the Service are described below.
  3. PURPOSES AND LEGAL BASES OF DATA PROCESSING IN THE SERVICEUSING THE SERVICE
    1. Personal data of all persons using the Service (including IP address or other identifiers, and information collected via cookies or other similar technologies) is processed by the Administrator:
      1. for the purpose of providing electronic services related to making Service content available to Users – the legal basis is the necessity of processing to perform a contract or take steps prior to entering into a contract (Art. 6(1)(b) and (f) GDPR), specifically for:
        – handling inquiries via forms available in the Service;
        – presenting offers or information;
        – providing ordered services;
        – carrying out direct marketing;
      2. for analytical and statistical purposes – the legal basis is the Administrator’s legitimate interest (Art. 6(1)(f) GDPR), consisting of analyzing User activity and preferences to improve functionalities and services;
      3. for establishing and pursuing claims or defending against claims – the legal basis is the Administrator’s legitimate interest (Art. 6(1)(f) GDPR), consisting of protecting its rights;
      4. for marketing purposes, in particular related to presenting behavioral advertising – the rules for processing personal data for marketing purposes are described in the MARKETING section.
    2. User activity in the Service, including personal data, is recorded in system logs (a special computer program used to store chronological records of events and activities related to the IT system used to provide services by the Administrator). The information collected in the logs is processed primarily for purposes related to providing services. The Administrator also processes it for technical, administrative, IT security, and system management purposes, as well as for analytical and statistical purposes – in this respect, the legal basis for processing is the Administrator’s legitimate interest (Art. 6(1)(f) GDPR).
  4. MARKETING
    1. The Administrator processes Users’ Personal Data for marketing activities, which may include:
      1. displaying marketing content tailored to the User’s interests (behavioral advertising);
      2. sending e-mail notifications about interesting offers or content, which in some cases contain commercial information;
      3. carrying out other types of analytical and statistical activities, as well as activities related to direct marketing of goods and services (sending commercial information electronically and telemarketing activities).
  5. COOKIES AND SIMILAR TECHNOLOGIES
    1. The Administrator uses cookies mainly to provide electronic services to the User and to improve their quality. Therefore, the Administrator and entities providing analytical and statistical services use cookies, storing information or gaining access to information already stored on the User’s end device (computer, phone, tablet, etc.). The use of cookies within the Service is not intended to identify Users. The Policy regulates the processing of data related to the use of own cookies.NECESSARY COOKIES
    2. The Administrator uses necessary cookies mainly to provide Users with services and basic functionalities of the Service that the User wishes to use. Necessary cookies may be installed only by the Administrator via the Service.
    3. The legal basis for processing data in connection with the use of necessary cookies is the necessity of processing to perform a contract (Art. 6(1)(b) GDPR).FUNCTIONAL AND ANALYTICAL COOKIES
    4. Functional cookies are used to remember and adjust the Service to the User’s choices. Functional cookies may be installed by the Administrator via the Service.
    5. Analytical cookies make it possible to obtain information such as the number of visits and traffic sources in the Service. They are used to determine which pages are more or less popular and to understand how Users move around the site by compiling statistics on Service traffic. Data processing is aimed at improving the Service’s performance. Information collected by these cookies is aggregated, so it is not intended to identify you. Functional cookies may be installed by the Administrator via the Service.
    6. The legal basis for processing personal data in connection with the use of functional and analytical cookies by the Administrator is its legitimate interest (Art. 6(1)(f) GDPR), consisting of ensuring the highest quality of services provided in the Service.
    7. Processing of personal data in connection with the use of functional and analytical cookies depends on obtaining the User’s consent to use (separately) functional and analytical cookies via the cookie consent management platform. This consent may be withdrawn at any time through this platform.ADVERTISING COOKIES
    8. Advertising cookies allow displayed advertising content to be tailored to the User’s interests within and outside the Service. Based on information from these cookies and the User’s activity on other sites, a User interest profile is created. Advertising cookies may be installed by the Administrator via our website.
    9. The legal basis for processing personal data in connection with the use of advertising cookies by the Administrator is its legitimate interest (Art. 6(1)(f) GDPR), consisting of ensuring the highest quality of services provided in the Service.
    10. Processing of personal data in connection with the use of advertising cookies is possible after obtaining the User’s consent via the consent management platform. This consent may be withdrawn at any time via this platform.
  6. DATA RETENTION PERIOD
    1. The period of data processing by the Administrator depends on the type of service provided and the purpose of processing. As a rule, data is processed for the duration of the service or order fulfillment, until consent is withdrawn or an effective objection is raised regarding data processing in cases where the legal basis for processing is the Administrator’s legitimate interest.
    2. The period of data processing may be extended if processing is necessary to establish and pursue possible claims or defend against claims, and after that only when and to the extent required by law. After the processing period expires, the data is irreversibly deleted or anonymized.
  7. USER RIGHTS
    1. The User has the right to access data and request its rectification, deletion, restriction of processing, the right to data portability, and the right to object to data processing, as well as the right to lodge a complaint with a supervisory authority dealing with data protection.
    2. The User has the right to object to data processing for marketing purposes if processing is based on the Administrator’s legitimate interest, and also – for reasons related to the User’s particular situation – in other cases where the legal basis for data processing is the Administrator’s legitimate interest (e.g., for analytical and statistical purposes).
  8. DATA RECIPIENTS
    1. In connection with service provision, personal data will be disclosed to external entities, in particular suppliers responsible for IT system maintenance and entities providing marketing services.
    2. The Administrator reserves the right to disclose selected User information to competent authorities or third parties who request such information based on an appropriate legal basis and in accordance with applicable law.
  9. TRANSFER OF DATA OUTSIDE THE EEA
    1. The level of personal data protection outside the European Economic Area (EEA) differs from that ensured by European law. For this reason, the Administrator transfers personal data outside the EEA only when necessary and with an adequate level of protection, mainly through:
      1. cooperation with entities processing personal data in countries for which the European Commission has issued a decision confirming an adequate level of data protection;
      2. using standard contractual clauses issued by the European Commission;
      3. using binding corporate rules approved by the competent supervisory authority.
    2. The Administrator always informs about the intention to transfer personal data outside the EEA at the stage of data collection.
  10. PERSONAL DATA SECURITY
    1. The Administrator continuously analyzes risks to ensure that personal data is processed securely – above all ensuring that access to data is granted only to authorized persons and only to the extent necessary for their tasks. The Administrator ensures that all operations on personal data are logged and carried out only by authorized employees and associates.
    2. The Administrator takes all necessary steps to ensure that its subcontractors and other cooperating entities provide appropriate security guarantees whenever they process personal data on behalf of the Administrator.
